We should give him the same presumption of innocence as anyone else. Dude, he was caught leaving the scene in the vehicle matching the reporting witness description, with empty spray paint cans and a crow bar, the TVs he had ripped off the wall and had already filed a claim with the insurance company while failing to notify police of the “break in” and damages. Welp, that's the crime. Insurance fraud. Pretty open and shut. Got him red handed, it sounds like. How about we charge him with a Hate Crime for falsely reporting a hate crime? According to the Southern Poverty Law Center, which makes hundreds of millions of dollars identifying alleged “hate groups”, there are less than 10,000 white supremacists, neo-nazis or white nationalists in the United States, a country of 327 million. That’s 0.003% of the population. There are more confirmed hate-crime hoaxes than people convicted of hate-crimes. There are more rapists and murderers walking the streets than the scary racists, many of whom’s only thought-crime is wanting to be separated from the people doing the majority of the killings and criminal violence in the United States. Statistically, there really isn't any white supremacy in America. In this country, more people drown in five-gallon buckets during a seven-year period than were killed by white supremacists in racially-motivated attacks in the last decade.

Dude actually played 4 seasons in the NFL for the Redskins, the Cowboys, and the Cardinals so with some good financial planning he never should have had to work another honest day in his life. Instead he invested in a pizzeria/ice cream parlor and probably blew the rest on a house and cars and frivolous stuff. So he thought he would just capitalize on the Jussie Smollett Plan and get a little media attention and insurance payout. I'd say the evidence is pretty clear and he got caught in the act. Now just imagine the very different story we would have been hearing from the media if a witness hadn't seen him vandalizing his own place.
